El predio de Las Tinajas amenaza con convertirse en el litigio del siglo luego de que por mayoría se aprobó su desincorporación y su venta a un precio mínimo de 33 millones de pesos.
Ahora el presidente municipal, Carlos Zataráin González, tendrá que enfrentar una demanda por despojo, aseguró ayer Catalina Ordaz Aguiar, quien dice ser la propietaria del terreno en disputa.
Desde hace 10 años Juan Cordero y Arturo Zaragoza empezaron a litigar en los juzgados con Granjas Monarca la propiedad de un terreno ubicado entre Las Tinajas y Los Arrecifes, pero desde abril de este año, justo cuando cobró fuerza la construcción de la carretera Costera y el proyecto del acuario-delfinario, el Ayuntamiento de Guaymas aseguró ser el propietario.
El caso está tan complicado que confundiría a cualquier jurista. Las tres partes afirman y exhiben documentos en los cuales se les acredita la propiedad, pero también las tres partes muestran documentos en donde aseguran haber vencido al “enemigo”.
El predio en litigio tiene una superficie de 266,599,595 metros cuadrados y cuenta con una de las mejores vistas al mar. Se encuentra a menos de cinco minutos por carretera del acuario-delfinario que construye el Gobierno del Estado.
El lunes en sesión de cabildo, después de varios meses de negociaciones, dos regidores independientes, dos panistas, el presidente municipal, la síndica y diez priistas decidieron desincorporarlo y ponerlo a la venta aun cuando los involucrados tienen serias dudas sobre la escrituración e inscripción de la propiedad en el Registro Público.

Fue un robo
“Nos están robando”, dijo ayer la empresaria turística Catalina Ordaz Aguiar, quien junto con su hermano compró el predio hace 15 años, según comentó.
Ordaz Aguiar aseguró que ese predio ya está vendido a unos empresarios de Arizona, por lo que la Comuna no puede venderlo nuevamente.
“Ese predio ya está vendido, que lo sepan los guaymenses, el presidente municipal y el secretario del Ayuntamiento nos están robando”, dijo.
Comentó que ellos son propietarios de 32 hectáreas que se dividen en dos predios de 15 y 17 hectáreas.
La empresaria aseguró que las autoridades municipales los borraron de Catastro y que el empresario Juan Cordero Jarero les invadió el predio.
“Nosotros adquirimos hace 15 años ese predio porque colindaba con el mar, nomás por eso, ahora sí, después de tantos años es el predio de la discordia, ahora sí todos lo pelean”, comentó.
Ordaz Aguiar dijo que los regidores y el presidente municipal cometieron un delito porque aprobaron la desincorporación de ese predio y desacataron una orden de un juez.
“Quebrantaron un amparo y eso es un delito, hoy mismo vamos a interponer una demanda en contra del presidente municipal”, dijo.
Dijo que lo más probable es que el presidente Carlos Zataráin González haya engañado a los regidores para que le aprobaran la venta del predio.

Fue un fraude
Y mientras los Ordaz Aguiar aseguran que la Comuna les está robando, la contraparte aseguró con documentos en la mano que José Ordaz Aguiar obtuvo las escrituras del predio a través de un fraude.
Y es que en un documento enviado a Juan Cordero Jarero por el Instituto Catastral y Registral del Gobierno del Estado, se señala que en esa oficina con fecha 18 de enero de 1949 quedó inscrita la escritura pública número 81 por medio de la cual Granjas Monarca, S. de R.L. de C.V. representada por su gerente Francisco Fourcade vende a los señores Ignacio Sierra y a Diego Santacruz el predio rústico denominado La Tinaja de Bacochibampo con superficie de 176,086.00 metros cuadrados.
Sin embargo, en julio del 2003 Granjas Monarca realizó un contrato de compra-venta con José Ordaz Aguiar por un predio rústico denominado La Tinaja de Bacochibampo con una superficie de 176,086.00, es decir, por el mismo predio que en 1949 ya había vendido la familia Fourcade a dos personas que ya fallecieron.
A decir de Cordero Jarero, con esa escritura Ordaz Aguiar pretende hacer creer que es dueño del predio en disputa.
“No es el mismo predio, por eso el litigio con Ordaz Aguiar no me preocupa, ése ya lo ganamos, me molesta que las autoridades municipales cometan una serie de ilegalidades para despojarme de lo que me pertenece”, dijo.

Diez años de litigio
El empresario Juan Cordero Jarero sostuvo que él lleva diez años peleando con José Ordaz Aguiar por ese predio y que ahora también lo está litigando contra la Comuna que en mayo pasado lo despojó del terreno.
Él también asegura ser el propietario del predio y lo demuestra con la resolución del Tribunal Colegiado del Quinto Circuito quien resolvió dentro del expediente 243/04 que Juan Cordero Jarero y Arturo Zaragoza Catalán como los propietarios de bien inmueble ubicado en el lado oeste del sector Las Tinajas de Distrito Judicial de Guaymas consistente en terreno cerril rústico con superficie de 9-83-88.52 hectáreas.
“Un tribunal ya nos otorgó la propiedad, si el Ayuntamiento de Guaymas no está de acuerdo que litigue el caso pero que no actúe al margen de la ley, que no venda ese predio si todavía no concluye el pleito”, dijo.
Cordero Jarero comentó que la Comuna no debe vender porque lo único que hará es enredar más el caso al introducir a una persona más al conflicto agrario.
“Yo estoy dispuesto a acatar la resolución de un juez, de un tribunal, pero ellos han actuado de una manera ilegal, así fue como inscribieron la escritura en el Registro Público de la Propiedad, no podían hacerlo y lo hicieron porque armaron artimañas”, comentó.

Se vende un problema
El secretario del Ayuntamiento, Marco Antonio Acedo Navarro, aseguró que quien compre el predio sabrá que está comprando un problema.
Aseguró a los ediles que el terreno sí se puede vender aun cuando esté en litigio ya que la ley lo contempla.
“Quien compre sabrá si le quiere entrar o no”, comentó.
Por su parte, el alcalde Carlos Zataráin González dijo que aún no tienen comprador y que dentro de quince días presentarán al Cabildo las bases de la licitación del predio valuado por la Comuna en 33 millones de pesos, pero disputado por las autoridades y cuatro empresarios guaymenses.
