The 4 lots and one 40 year public easement to the beach, at issue, are located in Sector Caracoal Turistico, San Carlos, Guaymas, Sonora, Mexico.

The lots are 4, 5, and 5-A, of that platted subdivision. Lot #6 is bundled with that group and is a special circumstance to be addressed later.

All lots are vacant, with no evident construction. All lots are bordered street side by calle Paseo De Las Almejas of Sector Caracol Turistico.

A commonly used locator would be - the NW end of La Posada Beach - the end of the beach opposite the end where La Palapa Restaurant is located.

Entering sector Caracoal Turistico, on calle Paseo De Las Almejas - the road closest to the beach, an interested person would pass a - pink colored - ¨H¨ shaped - delapidated condition - apt/condo. This building is located on lot #3 of the subdivision. Immediately after passing the pink building, there is an access road, 40 year public easement, to the Caracol Turistico side of La Posada beach.

This access road is command point for the Mexican Federal Army when it is declared a national emergency area - as was the case of the last hurricane.

In addition the water company uses this access road to accesss one its pumps. Also, it is used by contiguous residents for access to the rear of their properties. Most traffic is by local Mexican beach enthusiasts over the last 40 years.

The pink apt/condo is located on Lot #3, Caracol Turistico.

The owners of record of 3 of the 4 lots are as follows:
